Proposed Revisions to
Talega Gallery Community Association
Rules for the Election of Directors by Secret Ballot - Section 8
At the Board meeting on Tuesday, April 26th, the Board voted to send the proposed revisions to the Operating Rules, Section 8, Rules for the Election of Directors by Secret Ballot to members for a 28-day review.
This section of the Operating Rules has been revised as required by California Civil Code new section 5103 and revised section 5105, effective Jan.1, 2022. The law now allows for election by acclamation for uncontested elections when certain other requirements are met. Those requirements are included in the proposed revisions. Also, Section 8.5.1 has been revised, on advice of legal counsel, per current interpretation of Civil Code Section 5105(g)(1) that voting rights cannot be suspended, based on judges' opinions, etc.
